Fosnavaag, Norway – August 22, 201

Rimfrost AS, a Norwegian biotechnology company which supplies its RIMFROST Sublime krill oil to the world’s food supplement markets, announced today that the U.S. Patent & Trademark Office issued four (4) decisions finding that a reasonable likelihood exists that every claim of two (2) patents owned to Aker Biomarine Antarctic AS are unpatentable.

“We are gratified that the U.S. Patent Office has instituted Inter Partes Review proceedings of the Aker patents,” says Rimfrost owner Stig Remøy. “It confirms Rimfrost’s longstanding belief that the Aker patents are not valid and should have never been issued in the first place.

The two (2) patents were asserted against Rimfrost by Aker in a lawsuit brought in the District Court of Delaware and in an action before the U.S. International Trade Commission (ITC). Aker withdrew its complaint in the ITC and that proceeding was dismissed in May 2017.

In both proceedings, Aker maintained that Rimfrost’s process for extracting oil from krill and the resulting RIMFROST krill oil infringed various Aker patents. In response to Aker’s allegations, Rimfrost asserted that the Aker patents are not valid, and also filed four (4) petitions with the U.S. Patent & Trademark Office’s Patent Trial and Appeal Board asking the Patent Office to initiate proceedings to invalidate the two (2) Aker patents.

On August 16th, the Patent Trial and Appeal Board agreed with Rimfrost, and issued four (4) separate decisions ruling that Rimfrost had established a “reasonable likelihood” that each of the thirty-nine (39) claims recited in both challenged Aker patents “are unpatentable.”

Remøy emphasizes that “the arguments presented by Rimfrost, and agreed with by the Patent Trial and Appeal Board, are not the only reasons the Aker patents are invalid and unenforceable. Rimfrost intends to vigorously pursue other challenges to the validity and enforceability of the Aker patents in the appropriate U.S. Courts and the U.S. Patent Office.”

Counsel for Rimfrost also points out that as a result of the U.S. Patent Office instituting the Inter Partes Review proceedings in the Patent Office, Aker must now establish patentability before the Patent Trial and Appeal Board without the statutory presumption of validity provided by the U.S. Patent Statute. Moreover, the Federal District Court can be made aware that the Patent Trial and Appeal Board initially believes a reasonable likelihood exists that every claim of the challenged Aker patents is not patentable.

A new plant-based jerky that taps into consumer demand for an alternative to the popular meat-based snack combines coconut with a high-quality plant-based protein blend and will be introduced at Natural Products Expo West (NPEW) March 9-12 in Anaheim, California.

“Consumers are looking for snacks that are both healthy and satiating,” noted Bioriginal President Joe Vidal. “Coconut jerky was created with that in mind. We took an ingredient consumers trust and love – coconut – and combined it with other popular plant-based proteins like pumpkin and faba bean, to create a snack food that is portable and tasty.”

Bioriginal’s coconut jerky offering is not only plant-based and suitable for vegetarian and vegan lifestyles, but is gluten-free and a good source of protein.

According to market research firm IRI, the jerky market is a nearly $1.5 billion industry in the United States. The report noted sales were up by 13 percent since 2013, and by 46 percent since 2009.1

The health and wellness market remains strong in Brazil and consumers are increasingly looking for natural products with a high degree of added value. Krill oil from RIMFROST is characterized by its phospholipid bound omega-3 fatty acid content and clear red colour coming from the carotenoid antioxidant astaxanthin. Astaxanthin is known to be a highly potent antioxidant supporting the stability of cell membranes. As for all carotenoids, the bioavailability of astaxanthin is quite low. However, in association with krill oil phospholipids, the bioavailability of astaxanthin is increased.

RIMFROST AS is a Norwegian vertically integrated biotechnology company that provides high quality Antarctic krill products such as Rimfrost Pristine krill powder. This pinkish and free flowing powder is a natural combination of omega-3 phospholipids, astaxanthin, proteins and peptides and can be used in nutritional applications for humans and animals. In a collaboration with NOFIMA and Denmark Technical University (DTU), and with the financial support from the Norwegian Research Council, two stability studies have been performed. The results showed that the krill powder is stable and minimal degradation takes place.

As expected for all natural products krill powder is not inert. The results from NOFIMA showed that the astaxanthin decreased over time, however, there was no significant change in the other ingredients when stored at two years at room temperature. The DTU stability trial was shorter and has recently been published in the European Journal of Lipid Science and Technology. The results confirmed the high stability of the powder and that the overall oxidation and hydrolysis was low. The use of vacuum packaging increased the oxidative stability of the krill powder as determined by higher contents of astaxanthin and Vitamin E.

RIMFROST AS is a Norwegian vertically integrated biotechnology company that operates and controls the production of high quality krill products from raw material to finished capsules. The company’s recent innovation, a 100% pure krill oil extract with 60% phospholipids, has now obtained a favourable opinion from the Finnish Novel Food Board based on substantial equivalence and is therefore ready for the European market.

One of the strong benefits of krill is that omega-3s are bound to phospholipids – this feature has seen krill oil readily adopted by consumers who appreciate the enhanced absorption and comfort of use. Moreover, it follows that with RIMFROST’s innovative high-phospholipid RIMFROST SUBLIME 60% the levels of EPA and DHA are also greatly increased. RIMFROST SUBLIME 60% contains 30% more EPA/DHA than the previous generation of krill products. This allows formulators to develop new products with associated health claims for both EPA and DHA and also for choline which also features in greater levels in RIMFROST SUBLIME 60%.
The EFSA approved health claims are:

  • Choline contributes to normal homocysteine metabolism
  • Choline contributes to normal lipid metabolism
  • Choline contributes to normal liver function
  • EPA and DHA contribute to the normal function of the heart
  • DHA contributes to the normal brain function
  • DHA contributes to the maintenance of normal vision

“Krill oil is difficult to encapsulate due the presence of phospholipids and the industry has experienced difficulties with leaking capsules in the past. We have overcome this problem and we will therefore offer the product not only in bulk, but also in capsules” says Henrik Traaholt, VP Sales and Marketing Europe, RIMFROST AS.
“The product is high in astaxanthin and the EU regulatory approval allows the product to be marketed in concentrations up to 600 mg/kg. This natural high concentration provides our customers with an added value and is obtained because of the innovative technology applied at our New Zealand facility” says Inge Bruheim, Research Director.
